There are Two Types of Conservatorships:

Probate Conservatorship
Mental Heal
th Conservatorship

These Protective Orders Provide Care, Protection, Housing, Financial Support and Medical Therapy When the Person Can Not Provide for Themselves

CONSERVATORSHIPS TYPES

Probate Conservatorships

          

This is a legal process by which a person with a mental disease such as, a stroke, blunt trauma, brain tumor, or dementia are given legal protection to ensure that they have food, clothing, shelter and medical care.  This type of conservatorship can be initiated by a family member, a spouse, a friend, a social worker, or even a stranger.

 

It is characterized as:

     The mentally or physically incapacitated person is the Conservatee

     The person responsible for care is the Conservator

     The Conservatee suffers from a physical or mental disability

      It allows for INVOLUNTARY hospitalization ONLY if a court has ordered it because of dementia

      It is reviewed by the Court every two years

      It is most often over the Person and the Estate of the Conservatee

It can be over JUST the Estate of the Conservatee

      It is most often utilized for the care of the elderly, but can be applied to any age depending on the incapacity or inablility to handle the finances of the Conservatee

Mental Health Conservatorships (LPS)

      

This is a legal process by which a person with a mental illness, such as schizophrenia, paranoia, hallucinations or delusions are given legal protection to ensure that they have food, clothing, shelter and medical care.  This type of conservatorship is initiated by the psychiatrist and a medical treatment team.

 

It is characterised as:

     The mentally ill person is known as the Conservatee

     The Person responsible for care is known as the Conservator

     The Conservatee must be found to be “gravely disabled” by a psychologist or psychiatrist

     It is also known as a Lanterman, Petris and Short (LPS) Conservatorship

     It allows for the INVOLUNTARY hospitalization under the Probate Code, Section 5150.

     It must be reevaluated by the Court every year

     It is ALWAYS over the Person of the Conservatee

     It can be over the Person AND Estate of the Conservatee

     It is ALWAYS due to mental Illness at any age, but may have criminal issues due to incapacity to stand trial for the criminal charges
